Depositions
Once this paper work has been gathered it is common to take the statements of witnesses under oath. These are called depositions. This is done to prevent nasty suprises at trial. It makes it very difficult to change testimony at trial after giving a statement without appearing to be a liar.
Depositions are very costly, and you may balk at taking them, but there is a lawyer rule: Never ask a question at trial to which you do not know the answer!
